Section 504 of the Individuals with Disabilities Act, 1973

 

What is 504?

Section 504 of the Individuals with Disabilities Actis a federal law designed to protect the rights of individuals with disabilities in programs and activities that receive federal financial assistance from the U.S. Department of Education.  Section 504 covers qualified students with disabilities who attend schools receiving federal financial assistance.  At the elementary and secondary school level, determining whether a child is a "qualified" disabled student under Section 504 requires an evaluation process. 

 

What is the criterion for 504 eligibility?

Students who are eligible for Section 504 services must meet all three criteria:

1)  Have a physical or mental impairment;  2) that substantially limits  3) one or more major life activities.
